Arbitration and Mediation

At the law office of George L. Derr, Attorney at Law, in Eugene, Oregon, I serve as an Arbitrator or Mediator of various legal disputes:

Arbitration: Arbitration is a means of what is commonly referred to as Alternative Dispute Resolution (ADR) in which the disputing parties have either agreed to abide by the decision of one or more arbitrator(s).  Oregon law actually requires the parties to to a lawsuit to arbitrate certain disputes.

In arbitration, a civil dispute is submitted to an impartial third person(s). The arbitrator or arbitrator panel are either selected directly by the parties or are chosen in accordance with the terms of a contract in which the parties have agreed to use a court-ordered arbitrator or an arbitrator is appointed by the presiding judge of a county circuit court.

When there is no contract that provides otherwise, and where the parties have agreed to use more than one arbitrator, then, typically, each party chooses an arbitrator and the two arbitrators select a third arbitrator making the arbitration panel three arbitrators.

When parties submit to arbitration, they often agree to be bound by and comply with the arbitrators' decision. The arbitrators' decision is given after an often informal proceeding where each side presents evidence and witnesses.

As an arbitrator I am committed to the impartial and thorough consideration of every case that comes before me and will abide by the rule of law at all times.

Mediation: Mediation is another type of ADR that has as its goal, to facilitate the parties in a dispute towards reaching a settlement agreement. Mediation is a form of supervised settlement negotiation where the Mediator assists the parties at finding a common ground upon which they can agree to resolve their dispute, more or less amicably.

I work with parties in Lane County and throughout Central and Southern Oregon, including the cities of Eugene, Bend, Redmond, Salem, Corvallis, Albany, Roseburg, Grants Pass, and Medford, as well as Coos Bay, Coquille and Bandon on the Oregon Coast.
